One Year After Nebraska Said YES: Medical Cannabis Update

Exactly one year ago, 71% of Nebraska voters approved Initiative 437 to legalize medical cannabis and 67% created the Nebraska Medical Cannabis Commission to regulate it.
Here is the factual timeline of what has happened since.
Progress Made
The two voter laws remain in full legal effect.
The Commission has issued the first two cultivator licenses (one in Omaha, one in Raymond). Each grower may cultivate up to 1,250 flowering plants per harvest.
Applications for dispensaries, processors, and testing labs are open.
Twelve dispensaries will be allowed—one per judicial district.
Current Restrictions (Locked In November 3)
On November 3, 2025, the Commission voted 3-0 to keep every emergency rule unchanged until at least December 2:
NO raw flower, shake, trim, or pre-rolls
NO smoking or vaping
NO flavored products (natural or artificial)
NO edibles beyond unflavored gels or tablets
Only oils, tinctures, pills, patches, and suppositories
THC capped at 60% potency / 40 mg per dose
Commissioner Lorelle Mueting stated:
“Although 71% of Nebraskans voted for medical cannabis, we still owe it to them to provide it in a medical form that’s not going to lead to more harm than good.”

Patient registry cards: not yet live
First legal dispensary sales: earliest estimate – late spring 2026
Final rules lock December 1, 2025, unless changed at the December 2 meeting
Two denied cultivator applicants have appealed; decisions expected December
Legislative Reaction
On October 31, the General Affairs Committee held an interim study. Invited experts called the rollout an “utter failure” and warned that banning flower will prevent fast relief for seizures, chronic pain, and anxiety.
